An Innovation in Cross-Border Litigation: The New German Commercial Courts
The Legal Venue Strengthening Act allows the German states to establish Commercial Courts. The aim is to make the jurisdiction of state courts more attractive by implementing elements of arbitration. If the parties agree, they will be able to commence proceedings at the higher regional court. The entire civil procedure from complaint to judgment can be conducted in English. Judge Klink of the Stuttgart Commercial Court will analyze the legal framework and the newly created procedural instruments.

Zudem wird die Arbeitsweise der Gerichte untersucht, einschließlich der Ausstattung, Gerichtskosten und Verfahrensdauern. Ein weiterer Fokus liegt auf der Wettbewerbsfähigkeit, etwa durch spezielle Gerichte oder alternative Konfliktlösungsmechanismen. Abschließend wird der Einsatz von KI bei der Bewältigung von Massenverfahren thematisiert.

Petra Bárd’s upcoming speech tackles the EU’s struggle with Rule of Law backsliding in member states, offering a candid critique of its current tools and mechanisms. She highlights how illiberal regimes have exploited legal loopholes and institutional inertia, testing the EU’s response mechanism. Moreover, practical ways to address RoL issues efficiently will be highlighted and pathways for a transition back to the RoL explored, offering solutions for safeguarding the EU’s founding principles.
